Our Policies

1. Scope

These Terms and Conditions apply to all orders placed by consumers and businesses through our online shop.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession. A business is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their trade, business or profession.

The following applies to businesses: If a business uses conflicting or supplementary general terms and conditions, their validity is hereby rejected; they shall only become part of the contract if we have expressly agreed to them.

2. Contracting party, conclusion of contract, correction of input errors

The purchase contract is concluded with TICKET & TOUR Bert Weinhold Eintrittskarten WELTWEIT e.K.

The presentation of products in our online shop does not constitute a legally binding offer, but rather a non-binding online catalogue. You may initially place products in the shopping basket without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained during the ordering process. By clicking the order button, you submit a binding offer to purchase the goods contained in the shopping basket. Confirmation of receipt of your order will be sent by e-mail immediately after you submit the order.

We accept your offer within two days by

  • sending you a separate declaration of acceptance by e-mail, or
  • where applicable, having the payment transaction processed by our service provider or the selected payment service provider. The time at which the payment transaction is processed depends on the payment method selected (see “Payment”).

The relevant alternative is determined by whichever of the above events occurs first.

3. Contract language, storage of the contract text

The languages available for concluding the contract are German and English.

We store the contract text and send you the order details and our Terms and Conditions in text form. For security reasons, the contract text is no longer accessible via the internet.

4. Delivery conditions

Delivery options

Shipping costs are added to the stated product prices. Further details regarding shipping costs are provided with the respective offers.

You may generally collect your order from TICKET & TOUR Reisebüro, Münchner Str. 66a, 85221 Dachau, Germany during the following business hours: Monday to Friday, 9:00 a.m. to 5:00 p.m.

We do not deliver to Packstations.

5. Payment

5.1 Prices

The prices stated at the time of ordering apply. These are total prices and include statutory VAT where the product is subject to VAT.

5.2 Payment methods

The following payment methods are generally available in our online shop:

Advance payment
When you select advance payment, we will provide our bank details in a separate e-mail and deliver the goods after receipt of payment.

Credit card
During the ordering process, you enter your credit card details. Your card will be charged immediately after you place your order.

PayPal
To pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg (“PayPal”), you must be registered with PayPal, authenticate yourself using your login details and confirm the payment instruction. The payment transaction is processed by PayPal immediately after you place your order. Further information is provided during the ordering process.

PayPal may offer registered PayPal customers additional payment methods in their customer account based on PayPal's own criteria. We have no influence over whether such payment methods are offered; any additional payment methods offered individually concern your legal relationship with PayPal. Further information can be found in your PayPal account.

SOFORT by Klarna
To pay the invoice amount via the payment service provider Sofort GmbH, Theresienhöhe 12, 80339 Munich, Germany, you must have a bank account enabled for online banking, authenticate yourself accordingly and confirm the payment instruction. Your account will be charged immediately after you place your order. Further information is provided during the ordering process.

6. Right of withdrawal

There is no right of withdrawal for contracts relating to services in connection with leisure activities where the contract provides for a specific date or period of performance in accordance with Section 312g (2) No. 9 of the German Civil Code (BGB). Accordingly, every order for admission tickets is binding immediately upon confirmation by us and obliges the customer to accept and pay for the tickets ordered.

7. Warranty and guarantees

7.1 Liability for defects

Unless expressly agreed otherwise below, the statutory provisions on liability for defects apply.

The following limitations and reductions of limitation periods do not apply to claims arising from damage caused by us, our legal representatives or vicarious agents

  • in the event of injury to life, limb or health,
  • in the event of intentional or grossly negligent breach of duty or fraudulent intent,
  • in the event of a breach of material contractual obligations whose fulfilment is essential for the proper performance of the contract and on whose fulfilment the contracting party may regularly rely (cardinal obligations),
  • within the scope of a guarantee commitment, where agreed, or
  • where the German Product Liability Act (Produkthaftungsgesetz) applies.

Restrictions applicable to businesses

In relation to businesses, only our own statements and the manufacturer's product descriptions incorporated into the contract shall constitute an agreement as to the quality of the goods; we accept no liability for public statements by the manufacturer or other advertising statements. For businesses, the limitation period for claims for defects in newly manufactured goods is one year from the transfer of risk. The preceding sentence does not apply to an item that has been used for a building in accordance with its customary purpose and has caused the building to be defective.

The statutory limitation periods for rights of recourse under Section 445a BGB remain unaffected.

Provisions applicable to merchants

Between merchants, the duty to inspect and give notice of defects pursuant to Section 377 of the German Commercial Code (HGB) applies. If you fail to give the required notice, the goods shall be deemed approved unless the defect was not detectable during the inspection. This does not apply if we have fraudulently concealed a defect.

7.2 Guarantees and customer service

Information on any additional guarantees and their exact terms can be found with the respective product and on dedicated information pages in the online shop.

8. Liability

We shall always be liable without limitation for claims arising from damage caused by us, our legal representatives or vicarious agents

  • in the event of injury to life, limb or health,
  • in the event of intentional or grossly negligent breach of duty,
  • in the event of guarantee commitments, where agreed, or
  • where the German Product Liability Act applies.

In the event of a slightly negligent breach by us, our legal representatives or vicarious agents of material contractual obligations whose fulfilment is essential for the proper performance of the contract and on whose fulfilment the contracting party may regularly rely (cardinal obligations), liability shall be limited to the foreseeable damage typical of the contract at the time the contract was concluded.
Otherwise, claims for damages are excluded.

9. Governing law and jurisdiction

If you are a business, German law applies to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG).

If you are a merchant within the meaning of the German Commercial Code (HGB), a legal entity under public law or a special fund under public law, our registered office shall be the exclusive place of jurisdiction for all disputes arising from contractual relationships between us and you.

10. Severability

If individual provisions of these Terms and Conditions are wholly or partially invalid, the remainder of the contract shall remain valid. To the extent that individual provisions are invalid, the content of the contract shall be governed by the applicable statutory provisions.

11. Agreement on the use of Trusted Shops buyer protection

You can protect orders placed with us free of charge up to an order value of 100 euros with the buyer protection of Trusted Shops SE. In addition, Trusted Shops offers paid protection together with a guarantor. The Trusted Shops buyer protection conditions apply, which you can find here. Buyer protection is concluded by clicking on the appropriately designated button on the so-called trust card, which appears as a pop-up on the order thank you page after an order has been placed. If you are already registered for buyer protection, your order will be automatically secured (automatic buyer protection) without you having to click on the button. In order to be able to offer you (automatic) buyer protection, the Trustcard must access the order data stored in your browser's cache. For this purpose, a hash value of your e-mail address and the order number and order amount are sent to Trusted Shops. If you are already registered for buyer protection, your order will be automatically secured. If you are not yet registered for buyer protection, you can register using the Trustcard as described above.
